.... Respondents Through:

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 12.04.2018 It is submitted that petitioner and respondent no.2 have settled their disputes amicably, therefore, FIR No.

72/2017 under Sections 323/341/387/506/34 IPC registered at police station Nangloi may be quashed. A perusal of FIR shows that this is a case of road rage. Petitioner has already remained in jail for three months. Respondent no.2 is present in Court along with his counsel and has been identified by SI Pankaj Saroha of police station Nangloi. He submits that petitioner has apologised to him for his acts and he has accepted his apology. Compromise Deed dated 28th February, 2018 entered between the petitioner and respondent no.2 has been placed on record.

Learned APP opposes quashing of FIR on the ground that offence is serious in nature. Efforts were made by the petitioner to extort money from the respondent no.2.

Respondent no.2 states that no money was paid by him and it was a case of road rage which has now been settled. Keeping in mind the facts and circumstances of this case and the fact that matter has been settled between the petitioner and respondent no.2 voluntarily, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending.

Accordingly, aforementioned FIR, which is at the investigation stage, is quashed subject to, however, costs of `20,000/- to be deposited by the petitioner with the Delhi High Court Staff Welfare Fund within two weeks. Receipt, evidencing deposit of costs, be handed over to SI Pankaj Saroha of police station Nangloi.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.

Dasti.

A.K. PATHAK, J.
