By this petition, the petitioner seeks anticipatory bail in case FIR No. 140/2018 under Sections 376/506 IPC registered at PS Neb Sarai. 2.

In the complaint, the complainant alleged that she met the petitioner at the house of her friend's sister. Thereafter they became friends and he invited her at his house where the petitioner established physical relationship with her. After that he used to have physical relation with her on the pretext of marriage. One day she disclosed this fact to another lady and when the petitioner came to know about it he allegedly assaulted the complainant. 3.

After the complainant filed the FIR she also filed a written complaint to the police stating that the matter has been settled and she does not wish to pursue the complaint.

A perusal of the complaint itself reveals that first time when the relationship established between the parties there was no promise of marriage to the petitioner and it was only after relationship was established that the promise of marriage was extended.

Considering the various written representations of the prosecutrix and the charge sheet having been filed, this Court deems it fit to grant anticipatory bail to the petitioner.

It is, therefore, directed in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned/Court concerned further subject to the condition that the petitioner will join the investigation as and when directed by the Investigating Officer and will not leave the country without prior permission of the Court concerned and in case of change of residential address the same will be intimated to the Court concerned by way of an affidavit. 7.

Petition is disposed of.
