The petition is for the following reliefs:

i. Issue an appropriate writ, order or direction in the nature of Mandamus whereby directing the Respondent Nos.1 to 4 to enquire into the role of the Respondent No.5 and other police officials of P.S.- Burari, North District, Delhi regarding attempt to dispossess the petitioner from the plot admeasuring 200 square yards falls in Khasra No.46/6/2/2 located in the revenue estate of Village Burari abadi, now known as Gali No.6, A-Block, Kaushik Enclave, Burari, Delhi-110084 by misusing their official powers and police uniform and to also direct the Respondent No.5 to return the key of the main gate installed at the aforesaid property;

ii. Issue an appropriate writ, order or direction in the nature of Mandamus whereby directing the Respondents for disposing of the complaint dated 12.12.2025 (Annexure P-4) within the stipulated period in accordance with the guidelines contained in the decision rendered by the Constitution Bench of the Hon'ble Supreme Court of India in the case titled as, "Lalita Kumari Vs. State of Uttar Pradesh & Ors." reported in (2014) 2 SCC 1, which has been reaffirmed vide order dated 08.08.2023 passed by the Hon'ble Supreme Court of India in S.L.P. (Criminal) No.5883/2020 titled as, "Sindhu Janak Nagargoje Vs. The State of Maharashtra & Ors";"

respondent no. 5 and other policemen attempted to dispossess the petitioner from plot admeasuring 200 square yards, bearing Khasra No. 46/6/2/2 located in the revenue estate of village Burari abadi, now known as Gali No. 6, A-Block, Kaushik Enclave, Burari, Delhi-110084. 3.

Further, the petitioner claims that he has made a representation dated 12.12.2025 to respondents no. 1 to 4, seeking remedial action, but neither has any action been taken in this regard, nor has any reply been furnished thereto.

The appropriate recourse for the petitioner would be to file a private complaint against the concerned police officials before the competent Court. The Court exercising writ jurisdiction under Article 226 of the Constitution of India is not the appropriate forum to deal with such a grievance. Reference may be made to the decision of this Court in Wasim Khan v. Union of India and Ors.1 5.

Under these circumstances, the Court is unable to accede to the prayer made in the petition and accordingly, the instant petition stands disposed of.
