% 16.08.2016 This is an application filed under Section 14 (1)(a) of the Arbitration and Conciliation Act 1996, inter alia, praying that an order be passed terminating the mandate of the Sole Arbitrator appointed by the respondent. It is not in dispute that the Arbitrator has not held hearings for the past one year. Although, the petitioner has filed its statement of claims, the respondent has not filed the statement of defence as yet. The learned counsel appearing for the respondent states that further 10 days time would be required to appoint a new Arbitrator.
In the aforesaid circumstances, the present petition is allowed to the extent that the mandate of the Arbitrator appointed by the respondent is terminated. The new Arbitrator may be appointed within a period of two weeks from today. In the event, the same is not done, the petitioner would be at liberty to apply.
