% 07.10.2016 Crl. M.A. No.15977/2016 (modification of order dated 2nd June, 2016) 1.
The petitioner was granted parole to maintain social ties and to immerse the ashes of his demised mother, who expired on 13th December, 2015. The bail bond and the surety bond to be furnished, as directed vide order dated 2nd June, 2016 was ₹15,000/-. The petitioner seeks release on personal bond only.

The petitioner has been convicted for the rape of his minor daughter aged five years. It is thus apparent that on grant of parole the petitioner cannot be permitted to reside in the same family where the victim resides. 3.
Faced with this situation learned counsel for the petitioner submits that the petitioner will be residing with his sister. No material has been placed on record to show that the sister of the petitioner cannot stand surety for him.

I find no reason to modify the order dated 2nd June, 2016. 5.
Application is dismissed.

Copy of the order be communicated to the petitioner through Superintendent, Tihar Jail.
