IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 1881/2018 DHANNO DEV & ORS.
..... Petitioners Through Mr. Haneef Mohammad, Advocate.
versus STATE ( GOVT OF NCT OF DELHI) & ORS. ..... Respondents Through Mr. G.M. Farooqui, APP for the State.
Mr. Narender Malawaliya, Advocate for R-2 to 4 with respondent Nos.2 to 4 in person.
CORAM:
HON'BLE MR. JUSTICE SANJEEV SACHDEVA
O R D E R
% 14.05.2018 CRL.M.C. 1881/2018 1.
The petitioner seeks quashing of FIR No.299/2015 under Sections 354(A)/323/342/509/34 IPC, Police Station Pul Prahlad Pur. 2.
It is contended that the parties are related to each other. The subject FIR emanates out of a dispute which took place between the family of the complainant and her elder sister. 3.
Learned counsel for the petitioners submits that the parties have settled their disputes and the offences in the cross-FIR No.300/2015 have already been compounded based on the settlement of the parties before the National Lok Adalat on 09.09.2017. 4.
The respondent Nos.2 to 4 are present in person and represented by counsel. They submit that they have settled all the CRL.M.C. 1881/2018
disputes with the petitioners and they do not have any objection to the quashing of the subject FIR. They further submit that they do not wish to press their complaint against the petitioners. 5.
In view of the fact that disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.
6.
In view of the above, the petition is allowed. FIR No.299/2015 under Sections 354(A)/323/342/509/34 IPC, Police Station Pul Prahlad Pur and the consequent proceedings emanating there from are accordingly quashed.
