This writ petition seeking a writ effectively of quo warranto does not lie in the absence of a pleading of violation of a statutory provision in view of the ratios of various judgments of the Supreme Court including the judgments in the cases of B. Srinivasa Reddy vs. Karnataka Urban Water Supply and Drainage Board Employees' Association and Ors. (2006 ) 11SCC 731 and Rajesh Awasthi vs. Nand Lal Jaiswal and Ors. (2013 )1 SCC 501, and therefore, this writ petition is prayed to be withdrawn with liberty to the petitioner to file appropriate independent proceedings to seek the relief of declaration.
