Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') corresponding to Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the Petitioners, for quashing of FIR No. 363/2025 dated 08.10.2025 under Section 85/316(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 registered at Police Station Mansarovar Park and all the subsequent proceedings emanating therefrom.

It is submitted that the FIR No. 363/2025 has been registered against the Petitioner and his entire family under Section 498A/406/34 IPC on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. absolutely omnibus, vague and baseless allegations. The sister of the husband was not ever residing in the matrimonial home but she has also been roped in. There are no allegations but if so ever against the parents. There is a false allegation of the Complainant being forced to undergo abortion. The FIR is the blatant misuse of process of law and may be quashed.

On the specific query, it has admitted by the learned counsel for the Petitioner that the FIR has been registered only on 08.10.2025 and the investigations are still on going.

This is the initial stage where the matter is being investigated and all the allegations are under investigations to ascertain the truth of veracity of the same. This Court cannot sit as a Trial Court to ascertain the genuineness or the falsity of the investigations.

The present quashing Petition is not only pre-mature but is in fact to pre-empt any coercive action being taken against the Petitioners. 8.
There is no merit in the present Petition, which is hereby dismissed. 9.
The Petition is disposed of accordingly. Pending Application, if any, also stands disposed of.
