% 08.04.2016 CM No.13468/2016 (exemption) Allowed, subject to all just exceptions.

LPA 241/2016 1.

We have heard Sh.Pranav Sachdeva, the learned counsel appearing for the appellant/writ petitioner. We have also heard Sh.Digvijay Rai, the learned counsel, Sh.Rajiv Nayyar, the learned Senior Counsel and Sh.Santosh Kumar Tripathi, ASC, who appeared on advance notice on behalf of the respondents No.1 to 3 respectively. 2.

By the order under appeal, the learned Single Judge had dismissed C.M.No.6840/2016 wherein the writ petitioner/appellant herein had sought for suspension of collection of entry fee from the duly authorized and licensed drivers/owners of taxies working in the petitioner's network. The writ petition is pending and stands posted to 22.07.2016.

3.

Since the petition is yet to be heard by the learned Single Judge, it is neither proper nor necessary for us to go into the rival contentions of the parties and express any opinion on the merits of the case. Instead we deem it appropriate to advance the hearing of the petition before the learned Single Judge. The learned counsels appearing for the respondents No.1 and 2 have agreed that the counter affidavits on behalf of the respondent Nos.1 & 2 would be filed within three weeks from today without fail after serving a copy on the appellant/writ petitioner.

4.

Accordingly, we direct that W.P.(C) No.1585/2016 be listed on 17.05.2016 instead of 27.07.2016 for directions before the learned Single Judge.

We request the learned Single Judge to dispose of the petition expeditiously.

5.

The LPA stands disposed of.
