% 18.08.2017 IA No. 9299/2017 This application is moved to take on record the settlement between parties. The term of the settlement are enumerated in para 2 of this application.

The defendant undertake to comply with terms of the settlement. The undertakings have been given by Mr. Arun Kumar Parasa on behalf of defendants no.1 & 2 and by Mr. S. Suresh on behalf of defendant no.3. A Board Resolution passed by defendant no.2 in favour of Mr. Arun Kumar Parasa and a Board Resolution in favour of Mr.S.Suresh from defendant no. 3 is annexed. The parties agreed to the terms of settlement entered into and undertake the said terms shall also be binding upon their wholesalers, bottlers, proprietorship concerns, distributors, servants, dealers,

agents, representatives, associate companies, affiliates, subsidiaries, partners, successors in rights, interests and title and all others acting for and on their behalf. In view of the undertaking given by the defendants, the plaintiff does not press the claim of the damages and costs against the defendants.

In the circumstances this suit stands decreed in terms of para 2 of the application. Decree sheet be prepared. Since the suit is compromised before recording of the evidence on merits of the claims, the plaintiff shall be entitle of half of the amount of the court fee paid in respect of the claim. So much of the court fee be refunded.
