Lal Chand v. Land & Building Department
$~25 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 2729/2016 LAL CHAND ..... Petitioner Through Mr. N.S.Dalal & Ms. Ruchika Sharma, Advocates versus LAND & BUILDING DEPARTMENT ..... Respondent Through Ms. Ruchika Rathi, Advocate
CORAM:
HON'BLE MS. JUSTICE INDERMEET KAUR
O R D E R
% 05.08.2016 The plea of the petitioner seeking direction for an alternate plot had been rejected by communication dated 24.4.2014. The reason for the rejection was contained in that letter that the application dated 31.1.1994 of the father of the petitioner for allotment of an alternative plot has not been signed in original.
Contention of the petitioner is that inadvertently signature of the father of the petitioner on the application dated 31.1.1994 has been left out. Admittedly the case of the petitioner was not considered on merits and was rejected only on this ground alone. Applicant is directed to furnish a signed application form which shall now be filed before the competent authority within a period of one week from today and same shall be answered on its merits. It has
been informed to this court on the original application, namely, Bhim Singh expired on 18.7.1998. His legal representative Lal Chand who is pursuing this litigation is directed to file the requisite form along with other documents as so demanded by the department and the same shall then be considered in accordance with law. All documents required from the department shall be furnished over by the petitioner to the department within an outer limit of three weeks from today. Petition disposed of.
No further orders are called for.
