The instant petition under Section 528 of BNSS (earlier Section 482 CrPC) has been filed by the petitioner seeking quashing of FIR no. 894/2016, registered at PS New Usmanpur on 29.11.2016, for offences punishable under Sections 354/354D/354A/451/506 of IPC. 2.

Learned counsel for the petitioner submits that the petitioner is not physically present before the Court today.

It is further submitted that Mr. Devender Tiwari, the petitioner, is presently in the United Kingdom for a project. The brief facts of the case are that in the month of November, 2013, the petitioner enrolled in the Ph.D. (Mathematics) programme at Delhi University (hereinafter "DU"), pursuing a thesis in the Study of the Discreteness of Subgroups and Operators in Rank One Spaces. 5.

In July 2014, the petitioner and respondent no. 2, both students in the Mathematics Department at the DU came into contact. 6.

Despite respondent no. 2's clear rejection and subsequent engagement to another person, the petitioner continued to pursue her, causing distress. Aggrieved, she lodged a complaint in April 2016 with the Internal Complaints Committee of the DU, followed by an FIR on 29.11.2016 after the petitioner visited her residence on the eve of her marriage. The FIR No. 894/2016 was registered at PS New Usmanpur.

The petitioner was arrested on the same day and remained in judicial custody from 30.11.2016 to 03.12.2016 until he was granted bail. 8.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner and respondent no. 2 has settled their disputes amicably and are now moving forward towards a peaceful future. 9.

On a query made by this Court, respondent no. 2 has categorically stated that she has entered into this compromise on his own free will and without any pressure. It is also stated by her that the entire dispute has been amicably settled between the parties.

In view of the circumstances, both parties are desirous of quashing the abovementioned FIR in the interest of justice. Respondent no. 2 does not wish to pursue the proceedings arising out of FIR No. 894/2016 and, accordingly, has executed an Affidavit-cum-No Objection Certificate (NOC) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

in support of the present petition seeking quashing of the said FIR and all proceedings emanating therefrom.

The Affidavit-cum-NOC executed by respondent no. 2 is on record and has been annexed as Annexure P-3 in the petition. 12.

Heard learned counsel for the parties and perused the record. 13.

Keeping in view the fact that the matter stands amicably been settled between the petitioner and respondent no. 2 without any pressure, no fruitful purpose would be served by keeping the matter pending. 14.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR no. 894/2016 registered at Police Station New Usmanpur on 29.11.2016, for offences punishable under Sections 354/354D/354A/451/506 of the BNS, and consequent proceedings emanating therefrom, are quashed. 15.

With the above directions, the petition is disposed of along with pending application(s).
