IN THE HIGH COURT OF DELHI AT NEW DELHI

+ BAIL APPLN. 806/2018 RIFAKAT ALI ..... Petitioner Through Mr Sunil Kapoor, Advocate.

versus THE STATE (GOVT. OF NCT OF DELHI) ..... Respondent Through Mr Amit Gupta, APP for State.

Mr Amit Nahata, Advocate for complainant/R2.

ASI B.D.Sharma, P.S. Khajuri Khas present.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 08.01.2020 1.

The petitioner has filed the present petition, inter alia, praying for anticipatory bail in relation to FIR No. 61/2018 under Sections 498A/406/323/377/506/34 IPC registered with PS Khajuri Khas. 2.

The learned counsel appearing for the petitioner states that the petitioner had settled all the disputes with the complainant, however, the petitioner did not pay the amount as agreed by him. 3.

The concerned parties (the petitioner and his wife) were also referred to the Delhi High Court Mediation and Conciliation Centre. A report dated 14.10.2019 has since been received indicating that they could not settle their disputes.

4.

Mr Gupta, learned APP for the State states that the dowry articles have also not been recovered, as yet.

5.

Considering that it is an admitted fact that the petitioner had failed to pay the amount as agreed by him and as yet, the dowry articles have not been recovered, this Court does not consider it apposite to allow the present petition.

6.

The petition is dismissed.
