O R D E R

In instant appeal has been filed for reduction of the award dated 01.08.2025 passed by the learned MACT, awarding a compensation of Rs.31,11,768/- along with interest @ 8 % p.a. from the date of filing of claim petition.

Learned counsel for the insurance company has submitted that the awarded amount along with accrued interest has been attached before the Tribunal and the Hon'ble High Court has passed an order for disbursal of 80% of the awarded amount along with upto date accrued interest to the respondent/claimant(s) as per the award of the tribunal. It was informed by the Learned Counsel for the appellant that 80% of the awarded amount have already been disbursed to respondent/claimant(s) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

We note that in terms of the order dated 24.12.2025, the balance 20% of the awarded amount with accrued interest has been stayed by the Hon'ble High Court.

Learned counsel for the R-2 to R4 has submitted as per the instruction that the instant appeal may be disposed of as settled in terms of 80% of the awarded amount along with accrued interest which has been released to the claimant and same be considered as full and final settlement of subject matter of the appeal.

Learned counsel for the insurance company on instruction has agreed to the said proposal and has submitted that the balance 20% of the awarded amount along with accrued interest lying before the tribunal be refunded to insurance company.

Learned Counsel for the Insurance Company also submits that the statutory amount with interest, if any, may be refunded to the Insurance Company.

In view of the above settlement, the learned counsel for the respondents 2-4 have submitted that they have instructions to forgo the balance 20% of the awarded amount along with accrued interest and the awarded amount along with the accrued interest to the extent of 80% of the award granted by the tribunal which has already been disbursed to the respondent-claimant be treated as full and final settlement and respondents is satisfied with the said amount. 8.

In view of the submissions of the respondents, direction is issued to the tribunal to refund the balance 20% of the awarded amount along with accrued interest lying before the Tribunal to the insurance company The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The statutory amount along with interest, if any, be refunded to Appellant.

In terms of the aforesaid, the present appeal along with pending application(s) stand disposed of.
