Heard the learned counsel for the parties.

By instituting this petition, a prayer has been made to issue direction to the respondents to take appropriate action for stopping and demolishing the alleged illegal and unauthorized construction at property bearing no. E-9/2, Abul Faizal Enclave, Part-1, Jamia Nagar, Okhla, New Delhi. 3.

Delhi(MCD) informs that in respect of the property in question, certain actions have been taken. He further states that in March, 2025, the property in question was booked under Section 343 & 344 of the Delhi Municipal Corporation Act and certain action has also been precipitated on 29.05.2025. He further states that however, it has been noticed that certain encroachments have again been made, for which vacation notices have been issued. However, further action is not possible because of the introduction of Graded Response Action Plan-IV (GRAP-IV).

In view of the aforesaid fact, we dispose of the writ petition along with all pending applications, with the direction to the respondents to complete the requisite action for removal of encroachment and demolition of the illegal construction, if any, within a period of three months. The action once completed shall also be intimated to the petitioner.
