This petition has been filed by the petitioner with the following prayers:- "a.

Issue writ of mandamus or a writ/order/direction in the nature thereof calling for the records of the respondent pertaining to the present case and issue a writ, order and/or direction in the nature of certiorari setting aside the erroneous punishment dated 30.03.2024 awarded to the petitioner by his then commanding officer, 58, FMSD, Col. Sh. PK Sahoo along with the chargesheet dated 30.03.2024 u/s 63 ofthe Army Act, 1950 and further setting aside the order dated 13.12.2024 passed by the MG (MED) HQ Eastern Command (intimated to the petitioner vide letter dated 14.01.2025) upholding the punishment dated 30.03.2024 awarded to the petitioner; and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. b. Award cost in favour of the petitioner and against the respondent"

The learned counsel for the respondent has taken an objection on the maintainability of the petition on the ground that this Court lacks territorial jurisdiction inasmuch as the cause of action has arisen in the State of Assam or for that matter in Punjab, where the petitioner is presently posted. He also states that none of the representations as per the Regulations, as placed along with the writ petition have been addressed to the authorities in Punjab. 3.

At this stage, Mr. Anand Mishra, learned counsel for the petitioner states that he shall withdraw the writ petition to enable the petitioner submit/file appropriate petition/appeal/representation to his Commanding Officer(CO) in Punjab, where he is presently posted, to enable the CO to consider the grievance of the petitioner with regard to the penalty imposed on him.

If that be so, the petition along with pending applications is dismissed as withdrawn with liberty to make representation, in accordance with law. V.
