BAIL APPLN. 5080/2025 1.
This petition has been filed seeking extension of interim bail of the applicant in FIR No.172/2023, PS Special Cell, under Sections 21/29/61/85 Narcotic Drugs and Psychotropic Substances Act, 1985 ('NDPS Act') for a period of 60 days.

Though, it is stated in the application that the interim bail was granted on 11th December 2025, on account of the medical condition of father, a perusal of the order dated 11th December 2025 would show that the interim bail was granted on this ground on 13th October 2025 and has been extended on several occasions since then.

The medical condition of the father resulted in a knee surgery on 02nd The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
December 2025 and he was discharged on 04th December 2025. It is now stated that post the said surgery further complications have developed and a second surgery has been prescribed/recommended which is scheduled for 03rd January 2026.

As per the medical documents of Chawla (Urgent Medical & Surgical Centre) at D-27, Rajouri Garden, New Delhi, which stand verified by the State, as stated on instructions by the learned Assistant Public Prosecutor ('APP'), and also presented through a status report handed up in the Court, the condition for which the second surgery is proposed is extracted as under: "multiple bedsores with Fissure around in anus with injury of perpuse infection with burning of penis during passing urine. Pt is geetion dressing done of bed sore & fissure of anus and dressing of prepuse with contributed but no relief. Pt is in need of 2nd surgery (of perpuse & and fissure & debridments of ulcer on scrtrum & back. Pt condition is not good"

The applicant submits that his father is 79 years of age and only his wife is available at home to take care and, therefore, he needs extension of his interim bail.

Interim bail is opposed by the learned APP on the basis that petitioner was on interim bail previously on account of medical condition of his wife in 2024 and later for the medical condition of his father. Further, he points out to the order dated 11th December 2025 where the Court extended interim bail for three weeks mentioning that "interim bail cannot be granted indefinitely and that the applicant has already been on bail for more than two months". 7.
However, considering that the surgery is scheduled for 03rd January 2026, the Court considers it fit to extend the interim bail, till 26th January The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Further, a condition is imposed that in the event the surgery is not scheduled for 03rd January 2026, and a subsequent date is given, petitioner shall duly surrender.
