The present matrimonial appeal challenges the Order dated 19.12.2025 passed by the learned Family Court in Guardianship Petition No.29/2019, thereby disposing of the application of appellant filed under Section 151 of the Code of Civil Procedure, 1908, read with Section 12 of the Guardian and Wards Act, 1890.

Vide impugned Order, the learned Family Court passed an order granting interim visitation rights to the appellant during the winter vacation of the minor child.

Learned counsel for the appellant has raised the objection to the order on the ground of granting supervised visitation rights, unlike in past, when he got unsupervised custody/visitation rights of the minor child. 4.

impugned order was effective only till 07.01.2026 and that the said period, for which the order was passed, has almost expired. 5.

At this stage, learned counsel for the appellant seeks permission to withdraw the present appeal with liberty to file a fresh application before the learned Family Court, seeking appropriate orders with regard to visitation rights post 07.01.2026 and prays that the same be considered expeditiously. 6.

Accordingly, the present appeal stands dismissed as withdrawn with the liberty, as prayed for.

It is expected that the learned Family Court shall consider and decide any such application, if filed, expeditiously and in accordance with law.
