The present petition has been filed by the petitioner assailing the rejection(dated 26.12.2025) of the petitioner's bid submitted pursuant to he Notice Inviting Tender (NIT)/ Bidding Document No.
082176C/NRL/T/BOP‐LPG/21, pertaining to the Engineering, Procurement, Construction and Commissioning (EPCC) package comprising the "Balance of Plant Works for LPG Marketing Terminal". The petitioner has been sought to be technically disqualified on the ground that it did not meet the Bidder Qualification Criteria (BQC).

Learned counsel for the respondents submits that the opening of the Financial Bids is now scheduled on 06.01.2026 at 02:30 PM. Learned counsel for the petitioner informs that a representation has already been preferred by the petitioner against the rejection of its bid. The petitioner confines to seeking that the said representation be duly considered. 4.
In the circumstances, the present petition is disposed of with the direction that the said representation be duly considered by the respondents prior to the opening of the Financial Bids.

Needless to say, the aforesaid shall be without prejudice to the rights and contentions of the respondents, including as regards maintainability and the veracity of the allegations as set out in the present petition.
