The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.713/2015 registered under Section 420 IPC at PS Badarpur. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. During the course of arguments, on instructions, petitioner's counsel stated that the petitioner was ready to pay `2 lacs to the complainant without prejudice and subject to future adjustment (if any) within a month.
The petitioner is in custody since 15.12.2015.
Upon completion of investigation, a charge-sheet has already been filed.

Considering the facts and circumstances of the case and the petitioner's offer to pay `2 lacs (the alleged cheated amount) to the complainant without prejudice and subject to future adjustment (if any) within a month, he is admitted to bail on furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the Trial Court. He shall pay `2 lacs to complainant within a month through Investigating Officer by way of Demand Draft. In case of non-compliance, the complainant / State will be at liberty to approach this Court.

The bail application stands disposed of.
