On the issue of maintainability of the Revision Petition in this matter, petitioner's counsel is unable to assist. He simply states that the impugned order dated 19th December 2025 passed by the Executing Court has directed the bailiff not to execute the warrants of possession against the revisionist who is a tenant in the suit property till 05th January 2026. 2.

The same was extended on 02nd January 2026 by the Vacation Bench of this Court and listed today.

However, he states on instructions that the revisionist is a 74 years old person, who has been living on the property since 1995 as a tenant of the Judgment Debtor/ respondent no.4 (who is represented by Mr. Anil Tejan, Advocate), and undertakes to vacate the said property on or before 15th March 2026. Considering the undertaking before the Court, other aspects of the matter are not being addressed.

An affidavit in this regard would be filed by the petitioner, and be placed on record before this Court as well as the Executing Court within a period of one week. Further, a copy of the same will be given to the counsel for respondent no.4 as well as counsel for the Decree Holder, who appeared before the Executing Court.

Based on this undertaking, the petition is disposed of. 6.

Pending applications are rendered infructuous. 7.

Copy of the said order be sent to the Executing Court by the Registry. 8.
