% 05.09.2017 Petitioner approached this Court alleging unauthorised construction being raised in property bearing no. C-49/1, Arjun Nagar, Delhi. As per the status report filed on behalf of the respondent-SDMC, for the unauthorised construction being raised, actions were taken and it now surfaces that the building sanctioned plan has also been cancelled/revoked.

counsel for the owner/builder, who is the respondent no.3 on his part, submits that a statutory appeal has already been preferred against the adverse orders including revocation of the sanctioned building plan, before AT, MCD, who has inter alia granted an order restraining the respondent-
SDMC from carrying out any demolition action in the subject property on 07.06.2017. Copy of such order has come to be handed over during the course of hearing and the same is taken on record. In view of the given developments, nothing survives in the instant petition and is disposed off accordingly. Liberty is however, reserved to the petitioner to approach this Court afresh, if, any fresh cause of action arises or survives.
