% 13.07.2016 IA No.7945/2016 This is an application filed on behalf of Defendant Nos.1 & 2 inter alia praying for release of Rs.22,75,000/- deposited by Sh. Sunil Virmani (purchaser) by Pay Order No.195826 alongwith interest accrued thereon.

Learned counsel for the Applicants submit that in terms of the order dated 25.02.2015, defendant Nos.1 & 2 have executed the sale deed in favour of the plaintiff and have also received 75% of the total consideration of Rs.91.00 Lac. He has referred to the aforesaid order which expressly directs that the sum deposited by the purchaser with the Registry of this Court shall be appropriated by the defendant Nos.1 & 2 alongwith the interest accrued thereupon. The applicants / defendants have also annexed the true copy of the sale deed executed by them in favour of the purchaser along with the application.

In these circumstances, a need is not felt for issuance of any

notice to the non-applicants.

In view of above, the application is allowed and the Registry is directed to release the afore noted sum of Rs.22,75,000/- deposited by Suresh Virmani to the applicants/defendant Nos.1 & 2 along with interest thereon, if any, within a period of two weeks from today. VIBHU BAKHRU, J JULY 13, 2016 M
