The present Petition under Section 14 read with Section 15 of the Arbitration and Conciliation Act, 1996, has been filed by the Petitioner seeking termination of the mandate of the Arbitrator and appointment of a substitute Arbitrator, on the ground that the learned Sole Arbitrator does not possess the requisite experience and qualification specifically provided in Clause 12 of the Agreement for Working Capital Demand Loan dated 31.10.2023 entered into between the parties.

This Court vide Judgment and Order dated 22.11.2025 in Arbitration Petition bearing ARB P. No. 1592 of 2025, appointed the Sole Arbitrator to adjudicate upon the disputes between the parties. 3.

Sole Arbitrator does not possess the qualifications in terms of Clause 12 of the Agreement.

Resultantly, the mandate of the Arbitrator stands terminated. 5.

The Petition is disposed of.

It is open for the Petitioner to move an appropriate application under Section 11 of the Arbitration and Conciliation Act, 1996 to seek an appointment of an Arbitrator.
