This application is filed on behalf of the Plaintiff under Order XXIII Rule 1(3)(b) CPC for withdrawal of the suit in light of the fact that during the pendency of the present suit, parties have started exploring the possibility of a settlement at a global level, with liberty to file a fresh suit in respect of same subject matter and same cause of action. 2.

Dr. Vipin Wason, learned counsel accepts notice on behalf of the Defendants and on instructions does not dispute that the parties are exploring the possibility of an amicable settlement globally. 4.

For the reasons stated in the application, the same is allowed. 5.
