By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks issuance of appropriate writ/ direction to the learned JMFC, Mahila Court-01, North District, Rohini Courts, Delhi to dispose of the CT. No.3686/2017 filed under Section 12 of the Protection of Women from Domestic Violence Act, 2005 within a period of 3 to 6 months.

Petitioner appearing in person through VC submits that since the filing of the aforesaid case by the respondent, he has been facing various hardships as he is having difficulties in securing employment, international travel, financial hardships, etc. which has ultimately resulted in immense mental agony and social stigma on him. He further submits that since the filing of the aforesaid case, though the affidavit in evidence of the respondent/ complainant has already been filed long back on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 05.10.2024 and even then, her evidence has still not been recorded since she has either been filing repeated affidavits from then on or seeking adjournments on one or the other ground(s).

Considering the nature of the proceedings involved are emanating from the matrimonial disputes inter se the parties, the learned JMFC, Mahila Court-01, North District Rohini Courts, Delhi and the parties being of a marriageable age with their respective future ahead, this Court feel it appropriate for requesting the learned JMFC, Mahila Court-01, North District Rohini Courts, Delhi to make an effort to hear both parties for trying to dispose of the said CT. No.3686/2017 as expeditiously as possible, preferably within a reasonable time, although after giving due weightage and taking note of the pendency of the cases and the 'Daily Cause List' before it. Needless to say, the parties are also called upon not to seek unnecessary adjournment(s) during the pendency thereof in the said period.

In view of the relief prayed, as also the aforesaid order passed in the interest of justice as also both the parties involved, there is no need for issuance of notice to the respondent. As such, the same is dispensed with. 5.

Accordingly, the present petition alongwith the pending application is disposed of with the aforesaid directions.
