Heard the learned Counsel for the Parties.

The present Patent Appeal is filed challenging the order dated 23.12.2025 ("Impugned Order") in W.P.(C) 19512/2025 ("Writ Petition") wherein challenge was made to the Final Compensation Order dated 19.11.2025 ("Compensation Order") passed by the Nominated Authority, Ministry of Coal, Government of India.

Vide the Impugned Order, the learned Single Judge has disposed of the Writ Petition with the direction to the Appellant to exercise its remedy before the appropriate tribunal ("Tribunal") under Section 27(3) of the Coal Mines (Special Provisions) Act, 2015 ("Act") as permissible in law, within a period of 14 days.

The Impugned Order further directed that the direction contained in the Compensation Order shall be deferred till the said period of 14 days or till the Appellant approaches the learned Tribunal under Section 27(3) of the Act, whichever is earlier.

The learned Senior Counsel for the Appellant restricts his prayer to the extent that the deferment of the Compensation Order be extended till the application for stay of the Compensation Order is considered and disposed of by the learned Tribunal under Section 27(3) of the Act. 12.
The learned Senior Counsel for the Appellant also stated that the Appellant is in the process of approaching the learned Tribunal as per the liberty granted in the Impugned Order during the course of the day. 13.
Accordingly, we direct that if the Appellant approaches the learned Tribunal under Section 27(3) of the Act and if any application for stay of the Compensation Order is preferred by the Appellant, while raising the dispute The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
under Section 27(3) of the Act, the learned Tribunal shall decide the said application for stay within a period of 15 days from the date and the deferment of the Compensation Order shall continue for a period of 15 days from the date, subject to the Appellant furnishing the Bank Guarantee within a period of one week for the amount as directed by the Compensation Order. 14.
We make it clear that if the dispute is not raised under Section 27(3) of the Act within the time as stipulated by the learned Single Judge in the Impugned Order, benefit of this Order shall not be available to the Appellant.

The Appeal along with the Application stand disposed of in the aforesaid terms.
