The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), by the sister of Ms. xxx seeking issuance of a direction in the nature of Habeas Corpus, directing the respondents to produce the corpus of Ms. xxx. 2.

Mr. Sanjay Lao, the learned Standing Counsel appearing on behalf of the State, files the copy of the status report, which is taken on record.

The learned standing counsel submits that FIR no. 680/2025 was registered at PS North Rohini, Delhi at the instance of the petitioner. She stated in her complaint that her sister Ms. xxx, aged about 16 years, went missing from Dr. BSA Hospital on 12.11.2025. 4.

He further submits that Ms.

xxx has since been recovered/traced on 03.01.2026 from Bahadurgarh, Haryana. Her medical examination has already been conducted from Dr. BSA Hospital. Her statement under Section 183 of the BNSS has been recorded before the Court. He further states that this is the third time that the sister of petitioner has eloped with the same boy. 5.

Ms. xxx has been produced before the Court. We have interacted with her. She states that she is ready and willing to go to the custody of her parents. She further states that she has no complaint against her parents or her sister.

Considering the fact that Ms. xxx is a minor, aged about 16 years, and wants to stay with her parents and her sister, the petition is disposed of with direction to the respondents to restore the custody of Ms. xxx to her parents.
