The petition is essentially for quashing of the alleged blacklisting of the petitioner and directions to process and decide the petitioner9s pending application for Overseas Citizenship of India [8OCI9] within a stipulated period of time.

Ms. Avshreya Pratap Singh Rudy, learned counsel for the respondents, appears on advance instructions, submits that nothing has been brought on record to indicate as to when such a blacklisting was effected. She also submits that on the basis of the papers presented by the petitioner, the petitioner appears to be a citizen of the United States of America and does not have OCI status. She, therefore, submits that she be granted some time to take instructions and to file a reply. The Court, however, on perusal of the averments made in the petition finds that the grievance of the petitioner will have to be first decided by the concerned Department, in view of the extant rules and regulations, and therefore, there is no necessity for keeping this matter pending. 4.

Accordingly, the instant petition stands disposed of with the following directions:

i.

Let this petition be treated to be a representation on behalf of the petitioner by respondent No.1 or if the matter is to be dealt with by other Department, let respondent No.1 to transfer it to the concerned Department.

ii.

Let the concerned Department in turn to deal with the same and to take it to its logical end within a period of six months from the date of receipt of this order.

iii.

If the petitioner, thereafter, has any grievance, he shal be entitled to take appropriate recourse in acordinace with law.
