By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 482 of the Code of Criminal Procedure, 1973), the petitioner seeks quashing of FIR No. 895/2022 in Police Station Dabri, Dwarka, under Sections 498A/406/34 of the Indian Penal Code, 1860, on the ground that a settlement has been entered into between the parties. 2.
Ms. Arushi Mittal, learned counsel for the petitioner, states that although there are four accused in the FIR, the present petition inadvertently has been filed only on behalf of one accused. She, therefore, seeks permission to withdraw the petition, with liberty to file a fresh petition on the same cause of action.
