% 13.04.2018 Learned counsel for the respondents is present on advance notice.

After some hearing, learned counsel for the appellants states that the appellants would move an application under Order XXXIX Rule 4 of the Code of Civil Procedure, 1908 before the learned Single Judge, as the appellants perceive and believe that there is suppression and that wrong and incorrect facts have been stated. They would press for an early adjudication and decision.

Learned counsel for the respondents disputes this statement/assertion. He however submits that the respondents are interested and would want an early and expeditious disposal of the application for stay or vacation of ex-parte interim stay. Taking the aforesaid statements on record, the present appeal is

disposed of, without expressing any opinion on merits. The appellants may approach the Appellate Court in case there is delay in disposal and decision of the application for interim stay or vacation of stay. CM Nos.14488-89/2018 are also disposed of.
