% 02.01.2018 Counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to file a reply to the show cause notice in which it will be inter alia, pleaded that the final order should be kept in abeyance till decision of the Tribunal in the appeal to be preferred by the petitioner-assessee against an earlier order. 2.
The aforesaid plea and contention of the petitioner would be taken into consideration by the authorities.

The writ petition is dismissed as withdrawn with liberty to the petitioner to file a reply within four weeks from today. We clarify that we have not commented on merits. The adjudicating authority
would apply its mind independently and decide the issues and contentions raised.
