Allowed, subject to all just exceptions. Application is disposed of. W.P.(C) 73/2026 & CM APPL. 332/2026 (for interim relief) W.P.(C) 157/2026 & CM APPL. 816/2026 (for interim relief) 3.

The present petitions have been filed by the Petitioners under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ petition directing the Respondents to conduct a survey and to allow the Petitioners to peacefully vend at their vending sites. 4.

The vending site of the Petitioner -Ram Kishan in W.P.(C) 73/2026 is stated to be near the Brar Square Ring Road, Pillar No. 4-5, Metro Station Dhaula Kuan, Delhi Cantonment, Nangal Raya, Delhi Cantonment, New Delhi-110021.

The vending site of the Petitioner -Meag Singh in W.P.(C) 157/2026 is stated to be near the Brar Square Ring Road, Pillar No. 1, Metro Station Dhaula Kuan, Delhi Cantonment, Nangal Raya, Delhi Cantonment, New Delhi-110021.

The two Petitioners claim to be vendors, who have been vending since 2017 at their respective vending sites.

Cantonment Board at the vending site. The earliest challan in respect of Petitioners, which is placed on record in W.P.(C) 73/2026 is 19th February, 2020 and in W.P.(C) 157/2026 is dated 26th March, 2025. 8.

Mr. Mishra, ld. Counsel for the Petitioners fairly concedes that these vendors have not participated in the survey which has already been done by the Town Vending Committee.

Ld. Counsel for the Delhi Cantonment Board submits that the Town Vending Committee's meeting is in fact today. 10.

In this view of the matter, since the survey has already been concluded and the Petitioners did not participate therein, the Petitioners shall be at liberty to participate in the next survey, whenever conducted, if permissible, in accordance with law.

The consideration and participation in the survey shall be decided by the Town Vending Committee upon production of relevant documents by the Petitioners, and a decision shall be taken.

The petition is disposed of in these terms. All pending applications, if any, are also disposed of.
