Learned counsel for the petitioner states that during the pendency of the present petition, the respondents/ITBP have issued an order dated 16.7.2018, assigning seniority to the petitioner in the seniority list of 2010, in the rank of CMO (SG) above Dr. R.C. Sharma and in view of the O.M. dated 16.7.2018, enclosed with the aforesaid order, on the subject of amendment in the seniority list of Medical Officers cadre in CAPFs, NSG and Assam Rifles, as on 01.04.2017 whereunder the name of the petitioner has been reflected at Sr. No.4, he has been re-assigned his seniority from Sr. No. 119 to 109B in the rank of CMO (SG), nothing further survives in this petition. The petitioner seeks leave to withdraw the present petition to which learned counsel for the respondents has no objection. W.P.(C) 3660/2018
