This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :- "(i) Direct the respondent Nos. 1 to 4 Lo take immediate action to stop further unauthorized construction or any other building activity by the respondent No. 5 on the property, Address- A- 172, IIIrd Floor, DDA Flat, New Ranjit Nagar, New Delhi -110008.

(ii) Direct the respondent Nos. 1 to 4 to take action in accordance with the D.M.C. Act to seal and further The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

demolish the unauthorized construction raised by the respondent No. 5 by filing status reports before this Hon'ble Court;..."

The petitioner had earlier preferred another writ petition bearing W.P.(C) No. 13002/2024 titled Prem Lata v. Municipal Corporation Of Delhi Central Zone & Ors., wherein this Court in the paragraph Nos. 6 and 7 of the Order dated 17.09.2024, has issued the following directions:

"6. In view of the aforesaid, instead of keeping this petition pending on the Board of this Court, the petitioner is granted liberty to institute a civil suit against the concerned respondent or to approach the STF by way of proper representation along with the copy of this order. If the petitioner does so, let the grievance of the petitioner be dealt with by the STF, in accordance with law, as expeditiously as possible.

7. In view of the aforesaid, reserving the aforesaid liberty in favour of the petitioner, the instant writ petition stands disposed of."

Pursuant to the said liberty granted vide the aforesaid Order, the petitioner has already approached the STF by way of proper representation.

Consequently the respondent No. 4 i.e., STF, Delhi Development Authority has already filed a status report, which is relevant and the operative portion of the same reads as under: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Further action shall be taken as per DMC Act.

In this view of the matter, as per the status report filed by the respondent No. 4, the respondent No. 1 i.e., Municipal Corporation of Delhi (MCD) is already taking action following the due procedure of law.

Hence, I am of the view that the grievance of the petitioner, as far as the present petition is concerned, stands duly addressed. 7.

In case the petitioner is aggrieved by further action/inaction, the petitioner shall be at liberty to approach the Court in accordance with the law.

The petition is disposed of in the aforesaid terms, along with, pending applications, if any.
