The instant writ petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the petitioner for seeking parole for a period of two months. Status report not filed.

I have heard the learned counsel for the parties and have examined the file.

Nominal Roll dated 15.04.2018 reveals that the petitioner was convicted under Section 376/448 IPC and was sentenced to undergo Rigorous Imprisonment for seven years with fine `1,500/-.

Crl.A.No.914/2006 was dismissed by this Court on 06.11.2015. It further records that the petitioner has already undergone four years, W.P.(CRL) 1111/2018

eleven months and six days incarceration besides remission for one year, eleven months and six days as on 15.04.2018. Earlier he was granted parole on several occasions and there are no allegations it its misuse except that on one occasion he had surrendered three days beyond the period.

In the interest of justice and for the reasons mentioned in the application, the petitioner is granted three weeks parole from the date of his release, on his furnishing personal bond in the sum of `30,000/- with one surety in the like amount to the satisfaction of the Trial Court. After completion of parole period, the petitioner shall surrender before the Jail Superintendent.

Writ petition stands disposed of in the above terms. 6.
