This Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for issuance of a direction in the nature of a Writ of Habeas Corpus for tracing, production and safe recovery of the minor son of the petitioner.

The learned Standing Counsel for the State has produced before us a Status Report dated 21.01.2026 detailing the efforts that have been made by the respondents to ascertain the whereabouts of the missing boy.

The learned counsel for the petitioner submits that timely efforts were not made by the respondents to trace the missing boy. Be that as it may, the learned Standing Counsel fairly submits that investigation can be transferred to the Anti Human Trafficking Unit, Central District, Delhi Police for carrying out further investigation and make efforts to trace out the missing boy. 5.
In view of the above, we direct the investigation to be transferred to Anti Human Trafficking Unit, Central District, Delhi Police. We further direct that periodic reports of further investigations, on bi-monthly basis, shall be filed before the concerned Magistrate. Copy of such reports shall also be shared with the petitioner. 6.
The petition stands disposed with the aforesaid directions.
