Heard learned counsel representing the parties. 2.

This public interest litigation petition raises concerns about certain encroachments said to have been made over parks, which according to the petitioners belongs to Municipal Corporation of Delhi (MCD) and also at spaces around Shahi Jama Masjid.

Certain photographs have also been enclosed along with this writ petition which apparently depict encroachments and some illegal constructions, however, no definite opinion can be formed on the basis of the said photographs.

Accordingly, having regard to the nature of the issue raised in this writ petition, we dispose of this writ petition with the direction to the appropriate authority of the MCD to take into consideration the averments made in Annexures P-14, 15 and 16 appended to this writ petition and to verify the averments therein and conduct a survey within a period of two months. We further direct that in case, in the survey to be conducted under this order, any illegal construction or encroachment or illegal use is found, appropriate action, which may be warranted under law, shall also be taken by the appropriate authority, with expedition. 5.

The present writ petition stands disposed of in the aforesaid terms.
