O R D E R

% 04.05.2018 By this petition, the petitioner seeks parole on the ground of his ill health and also that his mother has been diagnosed from cancer and is under treatment at Dharmshila Cancer Hospital.

On a notice being issued status report has been filed. As per the status report family of the petitioner comprises of his mother, wife, son, brothers Maqbul, Mehboob and Gulam Hassan and are residing at H.No. 377, Double Storey, Welcome, Seelampur.

The treatment papers of the mother of the petitioner have also been verified and she is under treatment from Dharmshila Cancer Hospital. A perusal of the nominal roll of the petitioner reveals that the petitioner jumped parole on 6th May, 2002 and was arrested on 9th W.P.(CRL) 1134/2018

April, 2004, however, thereafter since 2007 he has been granted paroles by this Court and Government of NCT of Delhi, in the year 2007, 2008, 2009, twice in the year 2011, 2013, 2014 and 2017.

Considering that the petitioner is being granted regular parole since the year 2007 and there is no allegation of misuse thereafter this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with two surety bonds of the like amount, subject to the satisfaction of the learned Trial Court, further subject to the condition that the petitioner will report to the SHO, PS Welcome, Seelampur at 4:00 P.M. on every Monday till the period of his release. Petition is disposed of.
