This revision petition has been filed against an order dated 27.09.2025 passed by the Judicial Magistrate First Class, Patiala House Courts, by which bail has been granted to the respondent No. 2-accused in FIR No. 240/2025, dated 14.09.2025, registered under Sections 281/125(b)/105/238(a) of the Bharatiya Nyaya Sanhita, 2023, at Police Station Delhi Cantonment.

Mr. Atul Kumar, learned counsel for the petitioner, submits that the present petition be treated as a Criminal Miscellaneous Case ["CRL.M.C."] under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ["BNSS"] [corresponding to Section 482 of the Code of Criminal Procedure, 1973], as no revision lies against the impugned order.

In the interest of justice, the petition is renumbered and is treated as a petition under Section 528 of the BNSS. Mr. Atul Kumar, learned counsel for the petitioner, upon instructions, seeks permission to withdraw the present petition, without prejudice to the rights and contentions of the parties in the pending criminal proceedings, as the impugned order dated 27.09.2025 is an order granting bail to respondent No. 2, and it is well settled that the observations made by the learned Magistrate in the said order are prima facie in nature and confined to the adjudication of the bail application. 5.

The petition is dismissed as withdrawn.

All rights and contentions of the parties, including those of respondent No. 2, remain open before the Magistrate Court.
