The present writ petition has been filed by the petitioner under Articles 226 & 227 of the Constitution of India seeking setting aside of the Order dated 29.12.2025 passed by the learned Debt Recovery Tribunal-II, Delhi (hereinafter referred to as, 'DRT'). 4.

At the outset, a preliminary objection, with respect to the maintainability of the present writ petition to the extent that whether the challenge to an impugned Order passed by the learned DRT would lie under Article 226 of the Constitution of India or not, was raised by the learned counsel for respondent.
