Learned ASC for the State accepts notice.
Status report has been handed over which is taken on record. As per the status report the family of the petitioner comprises of his mother, four married sisters, two unmarried sisters and one unmarried brother who can all file SLP on behalf of petitioner. The address of the family has also been verified, however, it is stated that the family of the victim is staying in the neighbourhood. Infact, the petitioner has been convicted for offence of murder of his neighbour Golu, son of Charan Dass wherein not only Golu but other members of the family, namely Charan Dass, his daughter, wife and daughter-in-law received sharp W.P.(CRL) 1129/2018
injuries.
Further as per the nominal roll the petitioner was awarded jail punishment on 29th December, 2017 for misbehaving with the police staff. Considering the status report and nominal roll placed on record and that there are other family members who can file and pursue the special leave petition before the Hon'ble Supreme Court in the alternative the same can also be filed through legal aid provided in the jail, this Court finds no ground to grant parole to the petitioner.
Petition is disposed of.
Copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
