The learned counsel for the petitioner submits that the petitioner alongwith his deceased sister Smt.Joginder Gill had filed a suit for declaration/possession and permanent injunction seeking various reliefs in respect of the property being No.D-143, First Floor, Anand Niketan, New Delhi. The suit was filed in this court but now has been transferred to the jurisdiction of District Judge (South West), Dwarka. 2.

The learned counsel further submits that respondent No.1 has filed a probate petition being No.34/2011 seeking probate in respect of the said property which is pending adjudication before the court of Sh.Inderjeet Singh, ADJ-02 (South) Saket. This is fixed for today. 3.

The learned counsel further submits that it would be convenient for both the parties and in the interest of justice that the suit filed by the petitioner may be transferred from Dwarka to court of Sh.Inderjeet Singh, ADJ-02 (South) Saket, as it pertains to the same property. TR.P.(C.) 49/2016

The learned counsel for the respondent has no objection. 5.

Accordingly, the petition is allowed. Suit being CS No. 60/2016, titled 'Ragbir Singh Bhatti & Anr. v. Toshi Kapur' pending before Dr.P.S.Mallik, ADJ-03 (South West), Dwarka is transferred to the court of Sh.Inderjeet Singh, ADJ-02 (South) Saket to be heard alongwith probate petition which has been filed by respondent No.1 which is said to be fixed for today.
