The present writ petition has been filed by the petitioner seeking a direction to respondent nos. 3-6 to stop raising illegal and unauthorized construction in the property bearing no. 739, Haveli Azam Khan, Bazar Chilli Qabar, Jama Masjid, Delhi-110006.

A further direction is also sought for demolition of the aforesaid property.

It is the case of the petitioner that they had entered into an Agreement to Sell with respondent nos. 3-6 to purchase the third floor of the said property on the assurance that the property has been constructed as per sanction plans.

Earlier, a civil suit bearing no. CS SCJ 2325/2025, filed by the petitioner was dismissed as withdrawn on account of technical defects, with liberty to file a fresh petition as per law.

advance notice, submits that the aforesaid property has been constructed without any sanction plan and demolition order qua the said property has been passed on multiple occasions, the last being passed on 22nd December, 2025.

He further submits that demolition action has already taken place qua the said property and the concerned SHO has been directed to file an FIR against the respondent nos.3-6 as they have tampered with the sealing of the property, carried out by respondent nos. 1 and 2. 7.

In view of the aforesaid statement, no further orders are required to be passed in the present writ petition.

The writ petition stands disposed of.

Needless to state that the petitioner shall have liberty to initiate appropriate proceedings against respondent nos.3-6 in accordance with law.
