By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks quashing of FIR No.0308/2023 dated 06.09.2023 registered under Sections 279/ 338 of the Indian Penal Code, 1860 (IPC) at PS: Delhi Cantt as also all the proceedings emanating therefrom, in view of the Written Compromise dated 19.07.2025 arrived at inter se the petitioner and the respondent no.2 herein.

At the outset, the learned counsel for the petitioner submits that the present petition is accompanied by the Written Compromise dated 19.07.2025 as Annexure-4A, and is also supported by affidavit of the petitioner, alongwith proofs of the respective I.D.s. of both the petitioner The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

and respondent no.2. Additionally, both petitioner and respondent no.2, present in Court, have been identified by the Investigating Officer and the credentials of both, as on record, have also been duly verified by the Investigating Officer.

Issue Notice.

Learned APP for the State accepts notice. He confirms that he has no objection to the quashing of the aforesaid FIR. 5.

Respondent no.2 affirms the Written Compromise dated 19.07.2025 and states that he has already received one instalment of Rs. 62,500/- out of Rs.1,25,000/- and he has received the final instalment of remaining amount of Rs. 62,500/- via a demand draft dated 05.12.2025 bearing no. 104095 (Bank: SBI, Branch: Green Park) today in Court from the petitioner in full and final settlement of all his claims. He thus confirms that all disputes inter se themselves stands amicably settled in view of Written Compromise dated 19.07.2025.

In view of the fact that a settlement has already been arrived at between the petitioner and the respondent no.2, they shall remain bound by all the terms and conditions contained therein. As such, following the law laid down by the Hon'ble Supreme Court in Jitendra Raghuvanshi & Ors. Vs. Babita Raguvanshi & Anr. : (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr. : (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. : (2014) 6 SCC 466, this Court is of the opinion that continuation of the aforesaid FIR will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No.0308/2023 dated 06.09.2023 registered under Sections 279/ 338 IPC at PS: Delhi The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Cantt and all proceedings emanating therefrom are quashed. 8.

As such, the petition is disposed of.
