The present writ petition has been filed seeking quashing of the speaking order passed by the respondent on 14th August, 2025, theft bill for the sum of Rs. 2,87,464/- and the disconnection notice issued by the respondent.

At the outset, Mr. Manish Srivastava, counsel appearing on behalf of respondent no.1/GNCTD has placed reliance on a judgment passed by the Co-ordinate Bench of this Court on 1st July, 2024 in W.P.(C) 9215/2007, titled "Kishan Singh Shokeen v. B.S.E.S. Rajdhani Power Ltd. and connected matters", wherein it has been observed that in disputes involving electricity theft, tampering of meter, which are disputes related to questions of fact, a writ petition should not be entertained in such cases. 3.
The proper remedy for the petitioner would be to file a civil suit. 4.
Accordingly, counsel for the petitioner seeks to withdraw the present writ petition with liberty to approach the Civil Court.
