In view of the reasons mentioned in the above captioned IA, the above captioned IA is hereby allowed and stands disposed off accordingly.

OMP (E) COMM 1/2026 (under Section 27 of the Arbitration and Conciliation Act, 1996 for summoning of the witness).

Learned Counsel for the respondent accepts notice of the above captioned OMP and states that he has no objection, if the above captioned petition is allowed. By way of the abovesaid petition, the applicants seek summoning of witness i.e. Mr. Kapil Jain before the learned Arbitrator on the date already fixed i.e. 24.01.2026 and 28.01.2026.

In view of the reasons mentioned in the above captioned petition and the no-objection of the respondent, the above captioned petition is hereby allowed. Let, the witness i.e. Mr. Kapil Jain be summoned, on filing of the requisite process fee by the petitioners within two days, with directions to the witness to appear before the learned Arbitrator on the date already fixed before the learned Arbitrator i.e. 24.01.2026 and 28.01.2026. It is clarified that the diet money of the witness shall be borne by the petitioners and be payable at the spot.

The above captioned petition stands disposed off accordingly.
