This petition has been filed with the following prayers: "In view of the above, it is therefore most respectfully prayed that this Hon'ble court may graciously be pleased to; a) Restrain the respondents from further relegating the petitioner from present TES-49 course till final decision of the writ petition.

b) Pass any other order as may be deemed just and proper to secure the ends of justice."

The facts, as noted from the writ petition, are that the petitioner, on account of a deformity, namely ACL tear of the left knee, was downgraded from medical category SHAPE-I. It is a conceded position that the petitioner sustained the said injury during training.

Learned counsel for the petitioner, Mr. A. K. Trivedi, submits that the petitioner preferred an appeal to Chief of the Army Staff dated 31.05.2024, and representation dated 23.12.2025, by enclosing therewith opinion of the medical examination conducted at Safdarjung Hospital. It is his submission that the Safdarjung Hospital, New Delhi, after thoroughly examining the petitioner and conducting various tests, opined that the petitioner is fit to return to on-field rehabilitation and sprinting, and is also fit for ground duties, including long-distance walking and running. Pursuant thereto, the petitioner, vide his representation dated 24.12.2025, along with the medical certificate dated 23.12.2025 issued by Safdarjung Hospital, New Delhi, requested that this Court may direct the respondents to consider assessment of his medical fitness, as he is physically fit in all respects. 5.

If that be so, we dispose of the writ petition by directing the respondents to consider and decide the petitioner's appeal dated 31.05.2024 and representation dated 23.12.2025, keeping in view of the opinion given by Safdarjung Hospital, within a period of three weeks from today, and communicate the decision thereof to the petitioner. 6.

It goes without saying, in the event the petitioner is found medically fit, further action shall be taken strictly in accordance with the applicable rules. It is also made clear that if the petitioner is aggrieved by the order to be passed by the respondents, he shall be at liberty to avail such remedy as is available to him in accordance with law.
