A detailed order in this petition was passed on 10.1.2017. In terms of the said order the issue was as whether the petitioner was to be relieved or as to whether the petitioner will join the respondent no. 1/lending organization or the respondent no. 2/borrowing organization which had taken the services of the petitioner on deputation. Issue had arisen because respondent no. 2 had not relieved the petitioner and hence the petitioner could not join the respondent no. 1 and respondent no. 1 had therefore threatened disciplinary action against the petitioner.

Today, counsel for the petitioner states that petitioner has received a letter from the respondent no. 1 dated 21.1.2017 that petitioner can join respondent no. 1 organization on the extended deputation period which will come to an end on 31.1.2017. Petitioner, however, has not received the relevant order from the respondent no. 2.

It is, therefore, ordered that petitioner will now join the respondent no. 1 organization and there will be no requirement of relieving order to be issued by respondent no. 2 and which relevant order will be issued by the respondent no. 2 in due course but that will not prevent the petitioner from rejoining the respondent no. 1 organization within a period of one week from today. 4.

On account of the petitioner joining the services of the respondent no. 1/lending organization within a period of one week from today, the petitioner will be entitled to his salary from the respondent no. 1 with effect from 1.2.2017.
