By way of the present application, the applicant seeks regular bail in FIR No. 130/2025, dated 05.03.2025, registered under Sections 64(1)/74/351 of the Bharatiya Nyaya Sanhita, 2023, and Section 10 of the Protection of Children from Sexual Offences Act, 2012, at P.S. Sangam Vihar, District South, Delhi.

Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor, submits that although the prosecutrix has been examined, other material witnesses are yet to be examined before the Sessions Court. 3.
After some arguments, Ms. Aditi Singh, learned counsel for the applicant, seeks permission to withdraw the present bail application without prejudice to the rights and remedies of the applicant before the learned Sessions Court. complainant (mother of the victim) has not appeared before the Sessions Court on the last date of hearing for further examination. She, therefore, seeks appropriate directions in this regard to ensure the presence of the complainant.

In response, Mr. Chauhan submits that the prosecution shall take all necessary steps to secure the presence of the complainant before the learned Sessions Court on the next date of hearing and assures that no unnecessary adjournments shall be sought on behalf of the prosecution and the prosecution will make an attempt to expedite the recording of the testimonies of the remaining witnesses.

The application for regular bail is accordingly dismissed as withdrawn in terms of the above submissions. It is, however, made clear that the applicant shall be at liberty to approach the learned Sessions Court at an appropriate stage, including in the event of any inordinate delay in the recording of evidence of material witnesses. 5.
It is further clarified that this Court has not expressed any opinion on the merits of the case, and all rights and contentions of the parties are kept open.
